NBP represents 115 farmers in an antitrust lawsuit in federal court in Vermont filed against Dairy Foods of America (“DFA), the largest dairy cooperative in the United States and a milk processing conglomerate. DFA’s largest customer is Dean Foods. (NYSE: DF).
In November 2019, Dean Foods filed for bankruptcy, and announced that it was in “advanced discussions” to sell all of its milk processing plants to DFA. The proposed sale would solidify DFA’s market dominance/buying power in the Northeast, and seal the fate of the remaining independent dairy farmers struggling to survive.
The New York Times recently published an article discussing DFA’s conflict of interest in acquiring Dean’s milk processing plants, the impact such acquisitions have on prices paid to dairy farmers, and our pending lawsuit, which is scheduled for jury trial on July 1, 2020.
